These Terms and Conditions (“Terms”) govern your use of the website www.yachthiltonhead.com and all services provided by us, including all luxury yacht charters, bookings, and related amenities. By booking a charter with us, you agree to be bound by these Terms.

1. Booking, Payment, and Confirmation

1.1 Charter Agreement

All charters are subject to availability and formal confirmation via a separate Charter Agreement, which will detail the vessel, dates, times, total price, and specific inclusions (e.g., catering, crew, destinations).

1.2 Deposits and Final Payment

  • A non refundable deposit (specified in the Charter Agreement) is required to secure your date.

  • The remaining balance of the charter fee is due [5 days] prior to the scheduled charter date.

  • Failure to make final payment by the due date may result in the cancellation of your booking, and the forfeiture of your deposit.

1.3 Pricing

All prices quoted for a fully crewed yacht charter are inclusive of the vessel, fuel for the agreed itinerary, the Captain and attentive staff, and standard amenities. Additional services (premium catering, specific bar packages, dockage fees at external ports, extended itineraries) will be itemized separately.

2. Cancellation and Rescheduling Policy

2.1 Client Cancellation

  • Cancellations made [30 days] or more prior to the charter date will result in the forfeiture of the deposit.

  • Cancellations made less than [30 days] prior to the charter date will result in the forfeiture of the entire charter fee, unless we are able to rebook the vessel for the same date and time. If rebooked, we will refund the amount paid minus the deposit.

2.2 Weather Cancellation (Captain's Discretion)

  • The Captain holds the sole discretion to cancel a charter due to unsafe weather conditions (e.g., severe thunderstorms, high winds, hurricane warnings). Rain alone is not a cause for cancellation.
  • If the Captain cancels the charter due to weather, we will first attempt to reschedule your trip. If rescheduling is not possible, you will receive a full refund of all payments made.

3. Vessel and Crew Authority

3.1 Captain’s Authority

The safety of the vessel, crew, and all guests is paramount. The Captain of the vessel has absolute authority regarding the management of the yacht, its crew, itinerary, and all operational decisions, including the right to refuse service to any person or to terminate the charter early without refund due to dangerous, illegal, or unruly behavior.

3.2 Itinerary Customization

While we strive for customizable itineraries (e.g., sandbar stops, private sunset cruise Hilton Head, Savannah trips), all routes are subject to weather, tide, and vessel traffic conditions, and are always at the Captain’s discretion.

4. Client Responsibilities and Safety

4.1 Passenger Limits

Each vessel has strict U.S. Coast Guard certified maximum passenger limits (e.g., 6, 12, or more, as specified in your booking). Under no circumstances will this limit be exceeded.

4.2 Alcohol and Drug Policy

Guests are welcome to consume alcohol responsibly. Illegal drugs are strictly prohibited. Guests who become excessively intoxicated or endanger the safety of others will cause the immediate termination of the charter without refund.

4.3 Liability for Damage

The primary charter guest is responsible for the conduct of all guests and is liable for any and all damage to the vessel or its equipment caused by negligent or intentional actions of anyone in their party.

5. Limitation of Liability

Yacht Hilton Head and its affiliates shall not be liable for any personal injury, loss, or damage to the property of the charterer or guests, except where such injury, loss, or damage is caused by the proven negligence or willful misconduct of Yacht Hilton Head or its crew. By accepting these Terms, you agree to waive any claims against us for incidental, consequential, or punitive damages.

6. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of South Carolina and applicable U.S. Federal Maritime Law. Any disputes arising under these Terms shall be resolved in the appropriate court located in Beaufort County, South Carolina.
